Terms of sale
1. Definitions
Allure Hestia: refers to the entity offering the Client a stay in the Property and hotel selected by the Client on the Website.
Property: refers to a house (villa, chalet, mansion…) or a furnished apartment offered for rental to transient Clients, daily, weekly, or monthly, in accordance with Article L. 324 1 of the French Tourism Code.
Client or Traveler: any individual or legal entity making a booking with Allure Hestia.
Services: refers to the rental of the Property and any associated services provided by Allure Hestia.
Security Deposit: amount requested to cover potential damage to the Property, in accordance with Article L. 324 3 of the French Tourism Code.
2. Scope of Terms
These General Terms and Conditions apply to all offers, services, bookings, and provisions supplied by Allure Hestia, in accordance with Articles L. 211 1 to L. 211 14 of the French Tourism Code.
They are brought to the Client’s attention prior to any contract conclusion, pursuant to Article R. 211 4 of the French Tourism Code.
When applicable, Specific Terms prevail over these General Terms in case of contradiction, in accordance with Article L. 211 6 of the French Tourism Code.
3. Description of Services
Descriptions of properties and services are indicative. This practice complies with Article L. 121 1 of the French Consumer Code (pre-contractual information).
4. Property Booking
4.1 Process
Booking of a property is carried out in accordance with Articles L. 211 7 and R. 211 4 of the French Tourism Code.
4.2 Confirmation
Confirmation takes effect upon receipt by the Client of an email containing all contractual information, in accordance with Article L. 211 12 of the French Tourism Code.
5. Price and Payment Terms
All prices are expressed in euros and include applicable VAT, in accordance with Articles L. 241 1 to L. 241 4 of the French Tourism Code when the services are tourist services.
Payment of the deposit, balance, and security deposit is required within the deadlines specified, in accordance with Article L. 211 10 of the French Tourism Code.
6. Right of Withdrawal
In accordance with Article L. 221 28, 12° of the French Consumer Code, the right of withdrawal does not apply to services that must be provided on a specified date or period.
Consequently, the Client has no right of withdrawal beyond the booking confirmation for property rentals and associated services.
7. Modifications and Cancellations
7.1 By the Client
Cancellation and modification conditions are governed by Article L. 211 14 of the French Tourism Code.
7.2 By Allure Hestia
In case of a substantial modification of an essential element of the contract before departure, the Client has the rights provided in Article L. 211 13 of the French Tourism Code (acceptance or termination without fees).
8. Security Deposit and Refund
The handling and refund of the security deposit comply with seasonal rental practices and Article L. 324 3 of the French Tourism Code.
9. Client Obligations
The Client agrees to respect the usage rules of the rented property. In case of non-compliance, the Client is liable according to Article L. 211 15 of the French Tourism Code.
10. Allure Hestia Liability
Allure Hestia is only liable for damages caused by its own fault or that of its employees, in accordance with Articles L. 211 16 and L. 211 17 of the French Tourism Code.
In any case, liability is limited to the amount paid for the concerned service.
11. Force Majeure
Force majeure is defined by Article 1218 of the French Civil Code and automatically suspends the obligations of the Parties.
12. Applicable Law and Jurisdiction
These T&Cs are governed by French law.
Any dispute falls under the competent courts in accordance with Article 42 of the French Civil Procedure Code.
13. Data Protection
In accordance with the General Data Protection Regulation (GDPR) and French Law n°78 17 on data protection, Allure Hestia collects and processes the Client’s personal data transparently and securely.
14. Pre-contractual Information
In accordance with Articles R. 211 4 and R. 211 5 of the French Tourism Code, Allure Hestia provides the Client prior to signing:

• Total price
• Payment terms
• Cancellation and modification conditions
